Atlas

1. Acceptance

These Terms of Service ("Terms") govern your use of the Atlas mobile application ("Atlas", "the app"), operated from Türkiye. By downloading, installing, or using Atlas, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use Atlas. By using the app, you represent that you meet this age requirement. Users between 13 and 18 confirm that they have their legal guardian's permission where required by local law.

3. Accounts

Accounts are created exclusively through Sign in with Apple or Sign in with Google. We do not store passwords. You are responsible for the security of the third-party account you use to sign in and for all activity under your Atlas account.

You may delete your account at any time via Settings > Delete Account. Deletion is permanent.

4. The Service

Atlas is a location-based city exploration app. Core features include:

If you encounter content or behavior that violates these Terms, report it through the in-app Report feature or email us.

You may also block any user directly from their profile. Blocking hides their content from you and removes any friend connection.

8. Your Content

You retain ownership of the content you create in Atlas (such as usernames, group names and descriptions, polls, trips, goals, and place recommendations).

By submitting content, you grant Atlas a worldwide, non-exclusive, royalty-free, perpetual, transferable, and sub-licensable license to host, store, reproduce, modify (for formatting and technical purposes only), display, and distribute that content (a) for the purpose of operating, providing, and improving the app to you and the users you choose to share with, and (b) for promotional and marketing use by Atlas — for example, showcasing example groups, aggregated trip ideas, or anonymized highlights in app stores, on our website, or on our social media channels. Where reasonably possible, we will avoid displaying personally identifiable content in promotional materials without your consent.

Under the Turkish Law on Intellectual and Artistic Works (FSEK No. 5846), you also waive the right to object to such reasonable uses, to the extent permitted by law.

You represent and warrant that you have all rights necessary to submit any content you post, and that the content does not violate any third party's rights or Turkish law. If you withdraw content (e.g., by deleting a post or your account), we will cease active display of that content, but copies retained as part of routine backups or mandatory legal retention may persist until overwritten in the ordinary course.

9. Intellectual Property

Atlas, including its design, source code, gameplay mechanics (experience points, rarity system, passport metaphor, seasonal events), and the curation and selection of its location catalog, is the exclusive property of the Atlas team. You may not copy, modify, or create derivative works without prior written consent.

Location data (names, coordinates, descriptions of historical and cultural sites) is aggregated from publicly available open data sources and is provided for informational and exploratory purposes only. The underlying data remains subject to the license of its original source.

9.1 Third-Party Data Attributions

Atlas uses open data provided by the sources listed below. The following attributions are provided in accordance with the respective licenses. Additional sources may be added as Atlas expands to new cities and regions; this list will be updated accordingly.

10. Location-Based Features and Safety

Your safety and legal compliance are entirely your responsibility. Atlas encourages outdoor exploration. Remain aware of your surroundings at all times.

10.1 Military and Restricted Security Zones

Türkiye is covered by military forbidden zones and security zones regulated under Law No. 2565 ("Askeri Yasak Bölgeler ve Güvenlik Bölgeleri Kanunu") and related legislation. Entering these areas without authorization is a criminal offense under Turkish law and may carry severe penalties.

The presence of a point of interest ("POI") in the Atlas catalog does not constitute permission, authorization, or any indication that access to that location is lawful. Atlas does not verify, and cannot verify, the current legal status of every location, and regulations may change at any time.

It is your sole responsibility, before attempting to visit any location, to verify that (a) access is legally permitted, (b) the area is not a military forbidden zone, security zone, private property, or otherwise restricted area, and (c) you comply with all applicable signage and local enforcement orders. Atlas disclaims all liability for any criminal, administrative, civil, or personal consequences arising from your entry into any such area.

10.2 Compliance with Local Laws and Customs

You must at all times comply with the laws, regulations, ordinances, and customs of the places you visit while using Atlas — including, without limitation, traffic rules, photography restrictions (such as military, government, or religious sites where photography is prohibited), alcohol and substance laws, UNESCO site regulations, historical preservation rules, and local codes of conduct. Atlas is not liable for any violation — intentional or unintentional — of local laws or customs, or for any resulting penalty, fine, detention, deportation, or other consequence.

You use Atlas at your own risk. We are not liable for injury, loss, damage, fine, or legal penalty resulting from your use of the app or your physical presence at any location.

11. Service Availability and Virtual Items

Atlas is provided on an "as is" and "as available" basis. We do not guarantee:

We may modify, suspend, or discontinue any part of the service at any time.

11.1 No Monetary Value of In-App Progress

All in-app progression — including experience points (XP), levels, badges, rarity rewards, seasonal points (SP), stamps, passport entries, and any other virtual items — has no monetary or real-world value whatsoever.

These items are purely visual, in-app representations of engagement with Atlas. They cannot be sold, transferred, exchanged for currency or goods, redeemed, or otherwise monetized. They do not constitute a good, service, or consumer asset under Turkish consumer protection law.

In the event of server errors, data loss, bugs, service interruptions, account suspension, account deletion, termination of the app, or any other circumstance — whether within or outside our control — resulting in the loss or modification of any such virtual progression, Atlas has no obligation to restore, replace, or compensate you in any form, whether monetary or otherwise. Your remedy in such cases is limited to continued use of the service where available.

By using Atlas, you acknowledge and accept this principle.

12. Assumption of Risk

By using Atlas for outdoor exploration, you expressly assume all risks associated with travel and physical activity in urban, rural, historical, and natural environments.

You acknowledge that exploring points of interest — including historical sites, narrow streets, islands, coastal areas, hills, ruins, religious buildings, and similar locations — involves inherent risks, including but not limited to: injury, illness, sickness, or in rare cases death; traffic accidents; theft or loss of personal property; animal or insect encounters; weather exposure; unstable terrain; interactions with other persons; and civil or political disruptions.

You acknowledge that your decision to visit any location is made with consideration of this information, and you accept all personal risks attendant upon such travel. Atlas does not provide guides, transportation, insurance, or on-site assistance.

13. Force Majeure and Third-Party Services

Atlas is not liable for any failure, delay, interruption, loss, or damage caused by events beyond its reasonable control ("Force Majeure"), including but not limited to:

Atlas relies on third-party services to operate. We do not control, and are not responsible for, the availability, accuracy, performance, policies, or practices of these third parties. Changes to their terms, pricing, or availability may affect Atlas without prior notice.

14. Disclaimers

To the fullest extent permitted by applicable law, Atlas disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by applicable Turkish law, Atlas and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the app. Nothing in these Terms limits your mandatory consumer rights under Turkish law.

16. Termination

We may suspend or terminate your access to Atlas at any time, with or without notice, if you violate these Terms or if we determine that your continued access would harm other users or the service. You may stop using Atlas and delete your account at any time.

17. Claims and Complaint Period

If you have a complaint regarding Atlas or believe you have a claim against us, you must notify us in writing at [email protected] within thirty (30) days of the event giving rise to the complaint. Complaints submitted after this period may be considered waived, to the extent permitted by applicable law.

This provision does not affect any mandatory limitation period under Turkish law that cannot be contractually shortened.

18. Severability

If any provision of these Terms is found to be unenforceable, invalid, or void under applicable law, that provision shall be deemed severed or modified only to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date indicates when changes were made. Significant changes will be announced in the app. Continued use of Atlas after an update constitutes acceptance of the revised Terms.

20. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising out of or relating to these Terms or your use of Atlas shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul (Çağlayan), Türkiye, without prejudice to any mandatory consumer protection rights that may apply in your country of residence.

21. Language

The primary service language of Atlas is Turkish. These Terms of Service are provided in both English and Turkish. In case of any discrepancy or inconsistency between the English version and any translation (including the Turkish version), the version that reflects the intent of the parties and complies with mandatory Turkish consumer protection law shall prevail. Where Turkish law requires Turkish to be the authoritative language, the Turkish version shall prevail.
